Terms and Conditions for Enrollment and Participation – The Bamboo/Basalt Ferro-Cement Dome Building Workshop

THIS AGREEMENT is made on the date of purchase of Training and Workshop Services, Information,  Manuals, Guides, Plans and Specifications, building materials or components or DIY Kit
BETWEEN: Domeshells Australia Pty Ltd ABN 96 096426274 (hereinafter referred to as The Trainer)
and The Purchaser (hereinafter referred to as “the Participant” or “attendee”) of the second part.”The course” and “workshop” “training” refers to the above mentioned course The Company is the owner and developer of systems for building dome-shaped structures.

By enrolling in this course you agree to the following terms and conditions:

  1. You do not have any pre-existing physical or medical conditions that you have not declared to Domeshells that may effect your ability to perform light to medium physical work. Please ask us about anything you may not be sure of. We will not necessarily exclude anyone, we just need to know of any issue so that we can appropriately allow for it.
  2. You will successfully complete a national Construction Industry Health and Safety certificate course prior to attending the workshop. (this certificate can be obtained online from a number of training providers)
  3. As an attendee participant of the course/training, you agree to comply with the best practice of Work Place Health and Safety.
  4. Listen to and comply with the instructions of The Trainer while on the training site.
  5. The Participant indemnifies the Company against any actions, suits, claims, demands, proceedings, losses, damages, compensation, sums of money, costs (including solicitor and client costs), charges and expenses arising out of the promotion, sale, supply or other use of The Training by The Trainer, its servants or agents. The defense of any litigation to which this clause applies is to be under the control of the Trainer, its solicitors, and counsel, and all legal costs and expenses of any such litigation borne by the Attendee.
  6. Applicable law. This Agreement must be read and construed according to the laws of the State of Queensland, Australia and the parties submit to the jurisdiction of that State.

Payments:

Early Bird Payments

We offer a 10% discount in some cases for full payment by the indicated date

Deposit Payments

If you chose the deposit payment option, it does not qualify for an early bird price your balance of payment is due 2 weeks before the course start date, for which we will email you a reminder invoice.

If your balance payment is not received by 2 weeks out from the course start date, we reserve the right to cancel your booking and your deposit may be forfeited against costs.

Refunds:

We understand that sometimes circumstances change and you may not be able to attend a course that you have paid for.

As long as you notify us at least 21 days prior to the commencement of the course, your options are:

  • a refund of your course fee, less an administration fee of $150 per course booking
  • a credit of the full amount towards any future course.

Refunds and credits are not available within 14 days of a course’s commencement.

However, if you do wish to cancel within 14 days, give us a call – if our course has a waiting list, we’ll do our best to fill your place from our waiting list. If we are successful, we can credit your course fee for future courses.

Amendments. This Agreement may be varied in any manner at any time by the Trainer
Severability. If any provision of this Agreement is held by a court to be unlawful, invalid, unenforceable or in conflict with any rule of law, statute, ordinance or regulation it must be severed so that the validity and enforceability of the remaining provisions are not affected.

Disclaimer

The methods and systems demonstrated and taught in any of the workshops by DomeShells Australia are for educational purposes only. We make no guarantee that any structure built by any person attending the workshop or buying the manual will comply with required engineering and or compliance with local authorities. It is the responsibility of the workshop attendee to satisfy him/herself of their capability to perform the work. Plans and specifications provided with packages purchased from the Domeshells website are to Australian Standard which must be complied with.
